OFFICIAL RULES

PURCHASE IS NECESSARY TO ENTER. OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING RESIDENTS OF PUERTO RICO AND U.S. TERRITORIES), WHO ARE AT LEAST 13 YEARS OLD AT THE TIME OF ENTRY. VOID WHERE PROHIBITED. Employees of Grapery, Inc. (“Sponsor”) and its parent, affiliates, subsidiaries, advertising and promotion agencies, or any other party associated with the development or administration of this giveaway, and such employees’ immediate family members (parent, spouse, sibling, child, and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to enter. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this giveaway. This giveaway is subject to all applicable federal, state and local laws. Sponsor reserves the right to verify eligibility requirements of the winners.

ENTRY PERIOD: To be eligible, entries must be postmarked by December 31, 2020 (“Entry Period”). NOTE THIS PROMOTION IS OFFICIALLY ENDING ON DECEMBER 31, 2020.

HOW TO ENTER: PURCHASE IS NECESSARY. To enter the giveaway, an entrant must use the following entry method.

Entries: An entrant must complete the Grapery Galactic Giveaway Entry Sheet by collecting (3) "Moon Moolah" Proofs of Purchase found on the top of Grapery Moon Drops 2 lb. bags or bottom of 3 lb. clamshells in participating stores. The Entry Sheet can be downloaded and printed from www.grapery.biz/ggentry. Once completed with (3) Moon Drops Proof of Purchase clippings, entrant must mail in his/her Entry Sheet along with his/her first and last name, email address, street address (including city, state and zip), phone number and store/location to: Grapery Galactic Giveaway, c/o Grapery Inc., P.O. Box 970, Shafter, California 93263. All entrants that meet criteria will receive (1) Moon Drops/Lunar Loot item of Sponsor's choosing. Sponsor will not be responsible for lost, late, damaged, misdirected, illegible, postage-due mail or human error that may occur in the receipt or processing of entries. Entries must be postmarked no later than December 31, 2020.

Prizes: Sponsor will ship giveaway items to participants no later than January 31, 2021. Sponsor reserves the right to forfeit or give away any unclaimed or leftover prizes at its sole discretion. All giveaway items are awarded by Sponsor and subject to verification of eligibility as determined by Sponsor in its sole discretion and strict compliance with these Official Rules.

Giveaway items are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Participants are solely responsible for all federal, state and local taxes (including income and withholding taxes) and any other expenses, costs or fees associated with acceptance and/or use of the prizes not specified herein as being awarded. Participants may not substitute, assign or transfer prizes or redeem prizes for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or any portion thereof) with one of comparable or greater value. Additional restrictions may apply.

RELEASE: By participating in this giveaway, entrants agree to release and hold harmless Sponsor and its affiliates, and each of their respective past, present and future officers, directors, managers, employees, parents, subsidiaries, affiliates, agents, members, shareholders, insurers, servants, divisions, predecessors, successors, representatives, dealers, distributors, agents, including consultants and legal advisors (collectively, the “Released Parties”) from and against any claim, cause of action, liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity arising out of, in whole or in part, directly or indirectly, participation in this giveaway, or the acceptance, possession, use or misuse of any giveaway item(including any travel or activity related thereto).

General Conditions: Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries, or e-mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the sweepstakes, the processing of entries, the announcement of the prizes, or in any sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Released Parties are not responsible for injury or damage to participants' or to any other person's computer or electronic device related to or resulting from participating in this giveaway or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the giveaway or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the giveaway be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the sweepstakes and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Each winner, by acceptance of giveaway item, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the Entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.

MISCELLANEOUS CONDITIONS: By participating in the giveaway, entrants (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and its agents, which are final and binding in all matters relating to the giveaway. Failure to comply with these Official Rules may result in disqualification from the giveaway. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules and void all associated entries and/or votes.

ARBITRATION AND CHOICE OF LAW: Except where prohibited by law, as a condition of participating in this giveaway, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this giveaway, or any giveaway item received, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the contestant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this sweepstakes), and entrant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this giveaway, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA without regard to California’s choice of law rules.
